Arrest and court order
The Quintana Roo Attorney General's Office said Thursday that authorities had located Diego "N" in Valladolid after charges were filed against him. Prosecutors in Yucatan helped execute the arrest warrant before his transfer back to Quintana Roo.
A control judge formally linked him to trial, a procedural step known as vinculación a proceso, for his probable participation in rape and family violence. The judge ordered preventive detention for two years or for the duration of the proceedings, the prosecutor's office said.
Diego "N" is 23 and originally from Quintana Roo, according to a profile the office released while presenting several detainees in late October 2026. Its Specialized Prosecutor's Office for Combating Sexual Crimes and the Free Development of Personality handled the investigation that led to the warrant.
The office included his capture in an October 26, 2026, announcement about six people detained and linked to trial in cases involving sexual abuse, rape and family violence. Those cases spanned Othón P. Blanco, Benito Juárez, Tulum and Playa del Carmen.
Allegations date to April and May
Police said the charges concern rape and abuse alleged to have occurred in April and May 2026. Authorities' account begins on April 28, when the boy's mother left him with a neighbor before going to work. Diego "N", described as the woman's partner, would later pick him up.
The boy was admitted to Cancun's Jesús Kumate Rodríguez General Hospital on May 2. Authorities reported a traumatic brain injury with a hematoma, swelling around his left eye and suspected sexual abuse.
The medical assessment found evidence consistent with sexual assault, authorities said. The boy's mother was then advised to submit a complaint to the Public Prosecutor's Office.
Mother also faces charges
The child's mother, identified as Perla del Carmen "N", was arrested in May 2026 and charged with the same crimes, police said. She remains in pretrial detention.
